Coming into force
The Scottish Ministers make the following Order in exercise of the powers conferred by section 3AA(6)(c) of the Prisoners and Criminal Proceedings (Scotland) Act 19931 and all other powers enabling them to do so.
In accordance with section 45(3) of that Act, a draft of this instrument has been laid before, and approved by resolution of, the Scottish Parliament.
Citation and commencement1
This Order may be cited as the Home Detention Curfew Licence (Amendment of Specified Days) (Scotland) Order 2008 and comes into force on 21st March 2008.
Amendment of section 3AA(3) of the Prisoners and Criminal Proceedings (Scotland) Act 19932
In section 3AA(3) of the Prisoners and Criminal Proceedings (Scotland) Act 1993 (period during which prisoners may be considered for release on licence subject to a curfew condition), for “121 days” substitute “166 days”.
