The Edible Crabs (Conservation) (Amendment) Regulations (Northern Ireland) 2021

The Department of Agriculture, Environment and Rural Affairs(1) makes the following Regulations in exercise of the powers conferred on it by section 124(1) and (2) of the Fisheries Act (Northern Ireland) 1966(2) and Article 15(2) of Regulation (EU) 2019/1241(3) of the European Parliament and of the Council on the conservation of fishery resources and the protection of marine ecosystems through technical measures.

In accordance with Article 15(2) of Regulation (EU) 2019/1241 of the European Parliament and of the Council on the conservation of fishery resources and the protection of marine ecosystems through technical measures, the Department of Agriculture, Environment and Rural Affairs has obtained scientific evidence to support the measures made under Article 15(2) contained in these Regulations.

Citation and commencement

1.  These Regulations may be cited as the Edible Crabs (Conservation) (Amendment) Regulations (Northern Ireland) 2021 and shall come into operation on 8th January 2022.

Amendment of the Edible Crabs (Conservation) Regulations (Northern Ireland) 2020

2.—(1) The Edible Crabs (Conservation) Regulations (Northern Ireland) 2020(4) are amended as follows.

(2) After regulation 4 insert—

Detached crab claws

4A.  The retention on board, the bringing to land on or the landing from a sea-fishing boat of a detached edible crab claw is prohibited.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations prohibit the retention on board, the bringing to land and the landing from a sea -fishing boat, the detached claws of an edible crab. This measure is being taken for conservation reasons and is in accordance with the derogation power contained in Article 15(2) of Regulation (EU) 2019/1241.
