The Department of Justice, in exercise of the powers conferred by sections 36 and 41 of the Police (Northern Ireland) Act 2000(1), and of all other powers enabling it in that behalf, and after consulting the Northern Ireland Policing Board and the Police Association for Northern Ireland in accordance with section 41(6) of that Act(2), herby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Police Trainee (Amendment)(Coronavirus) Regulations (Northern Ireland) 2020.

(2) These Regulations shall come into operation on 10th April 2020.

(3) In these Regulations “the 2001 Regulations” means the Police Trainee Regulations (Northern Ireland) 2001(3).

Conditions for appointment as constable

2.  In regulation 3(3)(a) of the 2001 Regulations for “or such longer period” substitute “or such longer or shorter period of service”.

Leave

3.  In regulation 11(2A) of the 2001 Regulations for “regulation 3(4)” substitute “regulation 3(3)(a) or 3(4)”.

EXPLANATORY NOTE

(This note is not part of the Order)

These Regulations amend the Police Trainee Regulations (Northern Ireland) 2001 to allow the Chief Constable to impose different requirements as to the period of service and training for police trainees in response to COVID-19.

2000 c. 31. Section 36(4) was inserted by section 23(2) of the Police (Northern Ireland) Act 2003 (c. 6). Section 41(3) was amended by Article 5 of, and paragraph 63(a) of Schedule 3 to, the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010/976). Section 41(3A) was inserted by Article 8(4) of the Policing (Miscellaneous Provisions)(Northern Ireland) Order 2007 (S.I. 2007/912 (N.I. 6)).

Section 41(6) was amended by Article 5 of, and paragraph 63(3) of Schedule 3 to, the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010 No. 976).

S.R. 2001 No. 369. Regulation 3 was substituted by regulation 2 of the Police Trainee (Amendment) Regulations (Northern Ireland) 2003 (S.R. No. 436) and regulation 11(2A) was inserted by regulation 3(4)(c) of those Regulations.
