The Social Security (Invalid Care Allowance) (Amendment) Regulations (Northern Ireland) 2018

Coming into operation

The Department for Communities makes the following Regulations in exercise of the powers conferred by sections 70(8) and 171(1) of the Social Security Contributions and Benefits (Northern Ireland) Act 19921, and now vested in it2.

Citation and commencement1

These Regulations may be cited as the Social Security (Invalid Care Allowance) (Amendment) Regulations (Northern Ireland) 2018 and shall come into operation on 9th April 2018.

Amendment of the Social Security (Invalid Care Allowance) Regulations2

In regulation 8(1) of the Social Security (Invalid Care Allowance) Regulations (Northern Ireland) 19763 (circumstances in which a person is or is not to be treated as gainfully employed) for “£116” substitute “£120”.

Revocation3

The Social Security (Invalid Care Allowance) (Amendment) Regulations (Northern Ireland) 20174 are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend regulation 8(1) the Social Security (Invalid Care Allowance) Regulations (Northern Ireland) 1976 to increase, from £116 to £120, the amount of weekly earnings that a person can receive before being treated as gainfully employed for the purposes of entitlement to carer’s allowance.

Regulation 3 makes a consequential revocation.

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
