The Department for Infrastructure(1) makes the following Regulations in exercise of the powers conferred by Articles 27(1), 28(1) and 110(2) of the Road Traffic (Northern Ireland) Order 1995(2) and now vested in it(3).

Citation and commencement

1.  These Regulations may be cited as the Motor Cycles (Protective Headgear) (Amendment) Regulations (Northern Ireland) 2017 and shall come into operation on 30th June 2017.

Amendment of the Motor Cycles (Protective Headgear) Regulations

2.—(1) The Motor Cycles (Protective Headgear) Regulations (Northern Ireland) 1999(4) are amended in accordance with paragraphs (2) and (3).

(2) In regulation 2 (protective headgear)—

(a)in paragraph (1) after “motor bicycle” insert “or motor quadricycle”;

(b)in paragraph (3)—

(i)after the definition of “motor bicycle” insert—

“motor quadricycle” means a four-wheeled motor vehicle which—

(a)

has an unladen weight not exceeding 550 kilograms;

(b)

is steered by handlebars; and

(c)

is operated with the driver seated astride a seat which is mounted on the vehicle longitudinally;.

(3) In regulation 3(1) (prescribed types of recommended helmet)(5) after “in motor cycles” insert “or motor quadricycles”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Motor Cycles (Protective Headgear) Regulations (Northern Ireland) 1999. They introduce the definition of motor quadricycle and make it compulsory for riders of motor quadricycles to wear protective headgear when driving or riding on a public road.

These Regulations have been notified to the European Commission pursuant to Directive (EU) 2015/1535 of the European Parliament and of the Council of 9 September 2015 (O.J. L241, 17.9.2015, p1-15) laying down a procedure for the provision of information in the field of technical standards and regulations, and of rules on Information Society services.

A Regulatory Impact Assessment has not been produced for these Regulations as the effect is already included in the impact assessments prepared for the Road Traffic (Amendment) Act (Northern Ireland) 2016 (2016 c. 11 (N.I.)).
