Citation, commencement and interpretation
1.—(1) This Order may be cited as the Local Government (Exclusion of Non-commercial Considerations) Order (Northern Ireland) 2015 and shall come into operation on 30th June 2015.
(2) In this Order—
“the 1992 Order” means the Local Government (Miscellaneous Provisions) (Northern Ireland) Order 1992.
Matters cease to be non-commercial matters
2. The matters specified in Article 19(4)(a) of the 1992 Order (district council contracts: exclusion of non-commercial considerations) and the conduct of contractors or workers in industrial disputes between them as specified in Article 19(4)(d) of that Order shall cease to be non-commercial matters for the purposes of –
(a)Article 19 of the 1992 Order; and
(b)any functions regulated by Article 19 in relation to a public supply or works contract which involves a transfer of staff to which the Transfer of Undertakings (Protection of Employment) Regulations 2006(1) and the Service Provision Change (Protection of Employment) Regulations (Northern Ireland) 2006(2) may apply.
