The Department of Health, Social Services and Public Safety, in exercise of the powers conferred on it by article 10(1), (3), (4) and (5) of the Fire Services (Northern Ireland) Order 1984(1) and now vested in it(2) and with the approval of the Department of Finance and Personnel, in accordance with article 10(1) of that Order, makes the following Order:
1. This Order may be cited as the New Firefighters’ Pension Scheme (Amendment) (No. 2) Order (Northern Ireland) 2015 and shall come into operation on 12 February 2015 and shall have effect from 1 July 2014.
2. The New Firefighters’ Pension Scheme Order (Northern Ireland) 2007(3) shall be amended in accordance with the Schedule.

1. In Part 3 (Personal awards) in article 17(B)(1) (additional pension benefit) for “added pension benefit” substitute “additional pension benefit”.
2. In Schedule 2 (Appeal to Independent Medical Referee)—
(1) Paragraph 9A(4) is revoked.
(2) In paragraph 11—
(a)for sub-paragraph (3) substitute—
“(3) Where the appellant gives notice to the independent medical referee of withdrawing the appeal within 21 working days of the date appointed for an interview by the independent medical referee under paragraph 7(2), the Board may require the appellant to pay it such sum, not exceeding the total amount of fees and allowances payable to the independent medical referee under paragraph 10(1) as it thinks fit.”.
(b)in sub-paragraph (5)(a) for “paragraph 4” substitute “paragraph 7”.

This Order amends the New Firefighters’ Pension Scheme Order (Northern Ireland) 2007. Some of the amendments correct minor drafting errors. Paragraph 2 revokes and amends provisions of Schedule 2 (appeal to independent medical referee) so as to revoke changes made earlier this year and revert to the previous provisions.
The Order has effect from 1st July 2014. Powers to give the Order retrospective effect is conferred by article 10(4) of the Fire Services (Northern Ireland) Order 1984 as continued by article 60 of the Fire and Rescue Service (Northern Ireland) Order 2006.
A full impact assessment has not been produced for this Order as no impact on the private or voluntary sectors is foreseen.
