Statutory Sick Pay

The Department for Social Development makes the following Regulations in exercise of the powers conferred by section 122(4) of the Social Security Administration (Northern Ireland) Act 1992(1) and now vested in it(2).

Regulation 2 in so far as concurrence is required, is made with the concurrence of the Commissioners of Her Majesty’s Revenue and Customs(3).

Citation and commencement

1.  These Regulations may be cited as the Statutory Sick Pay (Maintenance of Records) (Revocation) Regulations (Northern Ireland) 2014 and shall come into operation on 6th April 2014.

Revocation

2.  Regulation 13 of the Statutory Sick Pay (General) Regulations (Northern Ireland) 1982(4) (records to be maintained by employers) is revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Statutory Sick Pay (General) Regulations (Northern Ireland) 1982 (“the 1982 Regulations”).

Regulation 2 of these Regulations revokes regulation 13 of the 1982 Regulations which provide for records concerning payments of Statutory Sick Pay to be retained by employers.

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.

An assessment of the impact of these Regulations on businesses, charities and the voluntary sector has been made.
