Commencement, transitional provision and savings

4.—(1) The fourth day after the next election day (within the meaning of the Electoral Law Act (Northern Ireland) 1962) following the making of this Order is the day appointed for the coming into operation of sections 1 and 3(1) of the 2008 Act for the purposes of—

(a)sections 1 (duty to make arrangements), 3 (annual budget) and 4 (report by chief financial officer on estimates) of the 2011 Act in so far as they relate to income and expenditure of district councils; and

(b)Articles 6 (regional rate and district rate), 7 (making of rates), 8 (time of making of, determination of amount of, and notification of, district rate), 34 (payments to district councils on account of district rates) and 35 (product of rate) of the Rates (Northern Ireland) Order 1977(1) in so far as they relate to rates,

for any financial year ending after 31st March 2014.

(2) Paragraph (1) has no effect in relation to an existing council in so far as it relates to sections 1 (duty to make arrangements) and 3(3) (annual budget) of the 2011 Act.

(3) Subject to paragraph (4), from the date appointed in paragraph (1), any reference to a “council” or “district council” in sections 1 (duty to make arrangements), 3 (annual budget) and 4 (report by chief financial officer on estimates) of the 2011 Act and Articles 6 (regional rate and district rate), 7 (making of rates), 8 (time of making of, determination of amount of, and notification of, district rate), 34 (payments to district councils on account of district rates) and 35 (product of rate) of the Rates (Northern Ireland) Order 1977 is a reference to a new council.

(4) In relation to an existing council, a reference to a “council” in section 1 (duty to make arrangements) or 3(3) (annual budget) of the 2011 Act is a reference to an existing council.
