7.—(1) Subject to the transitional provisions contained in Article 14 (entry into force and application) of Regulation 450/2009, any person who places on the market any active or intelligent material or article which does not comply with the requirements of Article 4 of that Regulation is guilty of an offence(1).
(2) Any person who fails to comply with the requirements of Article 13 (supporting documentation) of Regulation 450/2009 is guilty of an offence.
Article 4(e) does not apply until the date of application of the EU list of authorised substances that may be used in active and intelligent components
