Coming into operation
The Department of Finance and Personnel, in exercise of the powers conferred by Articles 3 and 18(5) of the Building Regulations (Northern Ireland) Order 19791 and now vested in it2, and after consultation with the Building Regulations Advisory Committee and such other bodies as appear to be representative of the interests concerned3, makes the following Regulations:
Citation and commencement1
These Regulations may be cited as the Building (Amendment) Regulations (Northern Ireland) 2012 and shall come into operation on 31st October 2012.
Interpretation2
In these Regulations “the principal Regulations” means the Building Regulations (Northern Ireland) 20124.
Amendment to Regulation 3 (Transitional provisions) of the principal Regulations3
The principal Regulations are amended as follows—
a
in regulation 3(2) for “These” substitute “Subject to paragraph (4), these”; and
b
after regulation 3(3) insert—

In relation to work or building work and a material change of use referred to in paragraph (2), a district council may serve a contravention notice under Article 18 of the Building Regulations (Northern Ireland) Order 1979 (including a notice in respect of anything of which particulars were not required to be shown in the plans deposited with the district council) at any time up to 12 months from the date of completion of the work in question.
