The Department of Agriculture and Rural Development is designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Union.
These Regulations make provision for a purpose mentioned in that section and it appears to the Department of Agriculture and Rural Development that it is expedient for references to Commission Regulation (EU) No 479/2010 laying down rules for the implementation of Council Regulation (EC) No 1234/2007 as regards Member States’ notifications to the Commission in the milk and milk products sector(3) to be construed as references to that Regulation as amended from time to time.
The Department of Agriculture and Rural Development makes the following Regulations in exercise of the powers conferred on it by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972(4).
1. These Regulations may be cited as the Reporting of Prices of Milk Products (Amendment) Regulations (Northern Ireland) 2011 and shall come into operation on 23rd March 2011.
2. The Interpretation Act (Northern Ireland) 1954(5) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
3.—(1) The Reporting of Prices of Milk Products Regulations (Northern Ireland) 2008(6) shall be amended in accordance with paragraphs (2) and (3).
(2) In regulation 2 (Interpretation)—
(a)for the definition of “Commission Regulation” there shall be substituted—
““Commission Regulation” means Commission Regulation (EU) No 479/2010 laying down rules for the implementation of Council Regulation (EC) No 1234/2007 as regards Member States’ notifications to the Commission in the milk and milk products sector, as amended from time to time;”; and
(b)for the definition of “milk products” there shall be substituted—
““milk products” means those products specified in Article 2(3)(a) of, and Annexes I.A and I.B to, the Commission Regulation.”.
(3) In regulation 3(1) (Provision of information on prices of milk products) for “Article 6” there shall be substituted “Articles 2 and 3”.

These Regulations which come into operation on 23rd March 2011 amend the Reporting of Prices of Milk Products Regulations (Northern Ireland) 2008 (S.R. 2008 No. 240) to refer to Commission Regulation (EU) No 479/2010 laying down rules for the implementation of Council Regulation (EC) No 1234/2007 as regards Member States’ notifications to the Commission in the milk and milk products sector (OJ No L 135, 2.6.2010, p 26), which has replaced the Commission Regulation previously referred to in those Regulations.

Paragraph 1A of Schedule 2 was inserted by section 28 of the Legislative and Regulatory Reform Act 2006 (c.51).
