The Department of Health, Social Services and Public Safety(1) makes the following Regulations, in exercise of the powers conferred by Article 13(1) to (4),(6) and (8) of the Social Security (Northern Ireland) Order 1988(2) and Section 171(2) to (5) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(3).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Healthy Start Scheme and Day Care Food Scheme (Amendment No. 2) Regulations (Northern Ireland) 2011 and shall come into operation on the 10th October 2011.

(2) In these Regulations “the principal Regulations” means the Healthy Start Scheme and Day Care Food Scheme Regulations (Northern Ireland) 2006(4).

(3) The Interpretation Act (Northern Ireland) 1954(5) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment to Schedule 5 to the principal Regulations

2.—(1) Schedule 5 (Statutory Provisions Applied For The Purposes Of These Regulations) is amended as provided by paragraphs (2) and (3).

(2) In the last entry in column 1 (Statutory Provisions) for “Section 3(2)(a)”substitute “Section 3 (1A)”(6).

(3) In the last entry in column 2 (Modifications) for “or employment or training” substitute “(d) retirement planning” and after “insert” insert “(e)”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Healthy Start Scheme and Day Care Food Scheme Regulations (Northern Ireland) 2006 (“the principal Regulations”).

Regulation 2 amends Schedule 5 to the principal Regulations, to allow the use of information where it relates to benefit under the Social Security Administration (Northern Ireland) Act 1992, for the purposes of the administration of a scheme under Article 13 of the Social Security (Northern Ireland) Order 1988.
