Subject to paragraph (2) an enforcement authority may publicise the cases in which—
a
items seized under regulation 12(5) have been destroyed;
b
compliance notices are given by it;
in such manner as it sees fit.

An enforcement authority shall not publicise a compliance notice given by it—
a
until the time for appealing against the compliance notice has passed;
b
during the period that any appeal against the compliance notice is ongoing; or
c
where an appeal against the compliance notice is successful.
