This new paragraph enables the Department of the Environment (“the Department”) to prescribe graduated amounts for offences. These graduations can take into account the circumstances of a particular offence.

Article 23 amends Article 30 of the Offenders Order to allow the Department to prescribe by Order the appropriate number of penalty points for offences depending on the circumstances.

Paragraph 18 of Schedule 7 substitutes Article 22 of the Offenders Order to allow the certificate issued by the Department to be used as evidence of registration or otherwise as an approved driving instructor.
