The Department of the Environment, makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1).

The Department of the Environment is designated(2) for the purposes of section 2(2) of the European Communities Act in relation to the regulation of the type, description, construction or equipment of vehicles and the regulation and supervision of the working conditions of persons engaged in road transport.

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Passenger and Goods Vehicles (Community Recording Equipment) Regulations (Northern Ireland) 2011 and shall come into operation on 5th September 2011.

(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment to the definition of the Community Recording Equipment Regulation

2.—(1) In each of the provisions specified in paragraph (2) for the definition of “the Community Recording Equipment Regulation” substitute—

“the Community Recording Equipment Regulation” means Council Regulation (EEC) No. 3821/85 on recording equipment in road transport(4) as read with the Community Drivers’ Hours and Recording Equipment (Exemptions and Supplementary Provisions) Regulations (Northern Ireland) 2009”(5).

(2) The provisions referred to in paragraph (1) are—

(a)regulation 2(1) of the Passenger and Goods Vehicles (Recording Equipment) Regulations (Northern Ireland) 1996(6); and

(b)regulation 2(1) of the Passenger and Goods Vehicles (Recording Equipment) (Tachograph Card) Regulations (Northern Ireland) 2007(7).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the definition of “the Community Recording Equipment Regulation” in the Passenger and Goods Vehicles (Recording Equipment) Regulations (Northern Ireland) 1996 and the Passenger and Goods Vehicles (Recording Equipment) (Tachograph Card) Regulations (Northern Ireland) 2007.

The amendments substitute a new definition relating to Council Regulation (EEC) No. 3821/85 so that the definition takes account of changes made to the Council Regulation as at the date of the making of these Regulations.
