The Secretary of State makes the following Regulations in exercise of the powers conferred by Articles 17(1) to (6), 20 (2), 40 (2) to (4) and 55 (2) of, and paragraphs 1(1) to (4), 2, 3(1), 5, 13, 14(1), 15 and 19 of Schedule 3 to the Health and Safety at Work (Northern Ireland) Order 1978 1 as so applied and modified by Article 53 and 54 of that Order as read with paragraph 1A of Schedule 2 to the European Communities Act 19722.
These Regulations make provision for a purpose mentioned in section 2(2) of the European Communities Act 1972 and it appears to the Secretary of State that it is expedient for the reference to the Dangerous Goods Directive3 to be construed as a reference to that instrument as amended from time to time.
In accordance with Article 46(1)(c) of that Order he has consulted with the Health and Safety Executive for Northern Ireland and such other bodies as appeared to him to be appropriate.
