This Statutory Rule has been made in consequence of a defect in Statutory Rule 2009 No. 142 and is being issued free of charge to all known recipients of that Statutory Rule.

The Secretary of State in exercise of the powers conferred on him by section 56(2) of the Police (Northern Ireland) Act 1998(1) hereby makes the following amending Order.
1. This Order may be cited as the Police and Criminal Evidence (Application to the Police Ombudsman)(Amendment) Order (Northern Ireland) 2010 and shall come into operation on 24th March 2010.
2. The Police and Criminal Evidence (Application to the Police Ombudsman) Order (Northern Ireland) 2009(2) shall be amended as follows—
(a)In Article 3(1) omit “by the police”;
(b)In Article 3(2) omit “Part II”;
(c)In Schedule 2 omit the introductory words “Where in the 1989 Order” to the end.

This Order sets out amendments to The Police and Criminal Evidence (Application to the Police Ombudsman) Order (Northern Ireland) 2009, which came into operation on 18 May 2009. The amendments have been made to rectify drafting errors in three respects as reported by the Joint Committee on Statutory Instruments in its 16th report of Session 2008-09.
There is no change to the policy as provided for in the Order which came into operation in May 2009.
