1. These Regulations may be cited as the Additional Statutory Paternity Pay (Weekly Rates) Regulations (Northern Ireland) 2010 and come into operation on 3rd October 2010.
2. The weekly rate of payment of additional statutory paternity pay shall be the smaller of the following two amounts—
(a)£124.88;
(b)90% of the normal weekly earnings of the person claiming additional statutory paternity pay, determined in accordance with regulations 31 and 32 of the Additional Statutory Paternity Pay (General) Regulations (Northern Ireland) 2010(1).
3. Where any payment of additional statutory paternity pay is made on the basis of a calculation at—
(a)the weekly rate specified in regulation 2(b); or
(b)the daily rate of one-seventh of the weekly rate specified in regulation 2(a) or (b),
and that amount includes a fraction of a penny, the payment shall be rounded up to the nearest whole number of pence.
