HORTICULTURE

These Regulations provide a new statutory framework for the enforcement of the Community marketing rules in the fresh fruit and vegetable sector provided for in Articles113 and 113a of Council Regulation (EC) No1234/2007 (O.J. No. L299, 16.11.2007, p.1) establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation), and contained in TitleII of Commission Regulation (EC) No.1580/2007 (O.J. No. L350, 31.12.2007, p.1) laying down implementing rules of Council Regulations (EC) No.2200/96, (EC) No.2201/96 and (EC) No.1182/2007 in the fruit and vegetable sector. In particular, they implement the revisions made to the Community marketing rules introduced by Commission Regulation (EC) No.1221/2008 (O.J. No. L336, 13.12.2008, p.1) amending Regulation (EC) No.1580/2007 laying down implementing rules of Council Regulations (EC) No.2200/96, (EC) No.2201/96 and (EC) No.1182/2007 in the fruit and vegetable sector as regards marketing standards.

The Department of Agriculture and Rural Development is designated1 for the purposes of section 2(2) of the European Communities Act (1972)2 in relation to the common agricultural policy of the European Community.

The Department of Agriculture and Rural Development makes the following Regulations under the powers conferred by section 2(2) of the European Communities Act 1972.

These Regulations make provision for a purpose mentioned in section 2(2) of the European Communities Act 1972, and it appears to the Department that it is expedient for references to provisions of Community instruments to be construed as a reference to those provisions as amended from time to time.

There has been open and transparent public consultation during the preparation of these Regulations as required by Article 9 of Regulation (EC) No. 178/20023 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety.
