Coming into operation-
11th January 2010
1.—(1) These Regulations may be cited as the Employment Equality (Age) (Amendment) Regulations (Northern Ireland) 2009 and shall come into operation on 11th January 2010.
(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.
2. In regulation 34 of the Employment Equality (Age) Regulations (Northern Ireland) 2006(4) (Exception for provision of certain benefits based on length of service)—
(a)at the end of paragraph (5)(a) omit “or”;
(b)after paragraph (5)(b) delete the full stop and add—
“; or
(c)in any case to which sub-paragraph (a) or (b) does not apply, that period is treated as a period of employment with A by or under an enactment pursuant to which his employment was transferred to A.”.

These Regulations amend the Employment Equality (Age) Regulations (Northern Ireland) 2006 (“the Age Regulations”) which implement Council Directive 2000/78/EC of 27th November 2000 establishing a general framework for equal treatment in employment and occupation (O.J. No. L303, 2.12.2000, p.16) so far as it relates to discrimination on grounds of age.
Regulation 2 amends regulation 34 of the Age Regulations so as to take account of statutory transfer schemes in relation to the exception for provision of certain benefits based on length of service.
