The Foyle, Carlingford and Irish Lights Commission, with the approval of the North/South Ministerial Council, makes the following Regulations in exercise of the powers conferred by section 13(1) of the Foyle Fisheries Act 1952(1) and section 13(1) of the Foyle Fisheries Act (Northern Ireland) 1952(2) and now vested in it(3).

Citation, commencement and application

1.—(1) These Regulations may be cited as the Foyle Area and Carlingford Area (Coarse Angling) Regulations 2009 and shall come into operation on 1st January 2010.

(2) These Regulations apply in the Foyle Area and the Carlingford Area.

Interpretation

2.—(1) In these Regulations “coarse fish” means fish of the following species—

(a)Bream (Abramis brama);

(b)Carp (Cyprinus carpio);

(c)Perch (Perca fluviatilis);

(d)Roach (Rutilus rutilus);

(e)Rudd (Scardinius erythrophthalmus);

(f)Tench (Tinca tinca).

(2) Any reference in paragraph (1) to a species of fish includes a hybrid of that species.

Prohibition and restriction

3.  A person shall not kill coarse fish by rod and line.

4.  Any coarse fish taken by rod and line shall be returned immediately to the waters from which it was taken without avoidable injury.

Amendment of the Foyle and Carlingford Area (Licensing of Fishing Engines) Regulations 2001

5.—(1) The Foyle and Carlingford Area (Licensing of Fishing Engines) Regulations 2001(4) are amended in accordance with paragraph (2).

(2) In regulation 2 (interpretation)—

(a)In the definition of “coarse fish” for the words “trout and rainbow trout” substitute “trout, rainbow trout and pike”;

(b)In the definition of “coarse fishing rod licence” for the words “fish for, take and kill eels and coarse fish” substitute “fish for, take and kill pike and to fish for and take eels and coarse fish”;

(c)In the definition of “game fishing rod licence” for the words “fish for, take and kill salmonids, eel and coarse fish” substitute “fish for, take and kill salmonids and pike and to fish for and take eels and coarse fish”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations prohibit the killing of certain species of coarse fish by rod and line in the Foyle and Carlingford Areas.

The Regulations also provide for consequential amendment of the definitions of “coarse fish”, “coarse fishing rod licence” and “game fishing rod licence” in regulation 2 of the Foyle and Carlingford Area (Licensing of Fishing Engines) Regulations 2001.
