The Department of Agriculture and Rural Development is a Department designated(1), for the purposes of making Regulations under section 2(2) of the European Communities Act 1972(2), in relation to the common agricultural policy of the European Community and makes these Regulations in exercise of the powers conferred by that section.

Citation and commencement

1.  These Regulations may be cited as the Products of Animal Origin (Third Country Imports) (Amendment) (No.2) Regulations (Northern Ireland) 2009; and shall come into operation on 19th October 2009.

Interpretation

2.  The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment of the Products of Animal Origin (Third Country Imports) Regulations (Northern Ireland) 2007

3.  The Products of Animal Origin (Third Country Imports) Regulations (Northern Ireland) 2007(4) are amended by replacing paragraphs (7) and (8) of regulation 4 (exemption for authorised products and personal imports) with the following paragraph—

(7) Part 3 (with the exception of regulation 25) and Parts 4 to 9 do not apply in relation to the products of animal origin specified in Article 2 of Commission Regulation (EC) No. 206/2009 on the introduction into the Community of personal consignments of products of animal origin.(5).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations further amend the Products of Animal Origin (Third Country Imports) Regulations (Northern Ireland) 2007 to take account of the changes in personal imports permitted from third countries brought about by Commission Regulation (EC) No. 206/2009 on the introduction into the Community of personal consignments of products of animal origin.

An Impact Assessment has not been prepared for this instrument as no impact on business, charities or voluntary bodies is foreseen.
