The Department of Education makes these Regulations in exercise of the powers conferred by Articles 11(1)(1), (2), (3), (3A) (2) and 14(1) and paragraphs 1, 3, 4, 5, 6, 8, 11 and 13 of Schedule 3 to the Superannuation (Northern Ireland) Order 1972(3).
In accordance with Article 11(5) of the Order consultation has taken place with representatives of local education authorities and of teachers and with representatives of other persons likely to be affected.
In accordance with Article 11(1) of that Order these Regulations are made with the consent of the Department of Finance and Personnel(4)
Citation and commencement and interpretation
1.—(1) These Regulations may be cited as the Teachers’ Pensions (Miscellaneous Amendments) Regulations (Northern Ireland) 2008 and shall come into operation on 1st March 2008 and shall have effect on and from 1st April 2007.
(2) In these Regulations —
(a)“the 1996 Regulations” means the Teachers’ Superannuation (Additional Voluntary Contributions) Regulations (Northern Ireland) 1996(5); and,
(b)“the 1998 Regulations” means the Teachers’ Superannuation Regulations (Northern Ireland) 1998(6).
Amendment of the 1996 Regulations
2. In regulation 16(2A) for “regulation 12(1)” substitute “regulation 12(1A)”.
Amendment of the 1998 Regulations
3. In regulation C1(8)(c) for “regulation C6 or C7” substitute “old regulation C6 or regulation C7”.
4. In regulation G7(2) for “H6A” substitute “H4B”.
5. In paragraph 14 of Schedule 2A for “by Department” substitute “by the Department”.

EXPLANATORY NOTE
(This note is not part of the Regulations.)
These Regulations amend the Teachers’ Superannuation (Additional Voluntary Contributions) Regulations (Northern Ireland) 1996 and also the Teachers’ Superannuation Regulations (Northern Ireland) 1998.
Regulations 2, 3, and 4 are to have retrospective effect as from 1st April 2007 by virtue of Article 14(1) of the Superannuation (Northern Ireland) Order 1972.
Regulation 2 corrects a cross-reference in the Teachers’ Superannuation (Additional Voluntary Contributions) Regulations (Northern Ireland) 1996.
Regulation 3 inserts an amendment relating to the stepping down arrangements in the Teachers’ Superannuation Regulations (Northern Ireland) 1998; this amendment was overlooked when the Teachers’ Pensions etc (Reform Amendments) Regulations (Northern Ireland) 2007 were drafted.
Regulations 4 and 5 correct a typing error.
