Amendment of the Legal Aid, Advice and Assistance Order

2.—(1) The Legal Aid, Advice and Assistance (Northern Ireland) Order 1981(1) is amended in accordance with paragraphs (2) to (4).

(2) In Article 3(1)(b)(2) (persons eligible for advice and assistance) for the words from “or an income-based jobseeker’s allowance” to the end substitute “, an income-based jobseeker’s allowance (payable under the Jobseekers (Northern Ireland) Order 1995) or an income-related allowance under Part 1 of the Welfare Reform Act (Northern Ireland) 2007 (employment and support allowance).”.

(3) In Article 7(2)(3) (contributions from persons receiving advice or assistance) for “or an income-based jobseeker’s allowance (payable under the Jobseekers (Northern Ireland) Order 1995)” substitute “, an income-based jobseeker’s allowance (payable under the Jobseekers (Northern Ireland) Order 1995) or an income-related allowance under Part 1 of the Welfare Reform Act (Northern Ireland) 2007 (employment and support allowance)”.

(4) In Article 14(5)(4) (assessment of disposable capital and income and of maximum contribution) for the words from “or an income-based jobseeker’s allowance” to the end substitute “, an income-based jobseeker’s allowance (payable under the Jobseekers (Northern Ireland) Order 1995) or an income-related allowance under Part 1 of the Welfare Reform Act (Northern Ireland) 2007 (employment and support allowance).”.

Article 3(1)(b) was amended by paragraph 36(1)(a) of Schedule 9 to the Social Security (Northern Ireland) Order 1986 (S.I. 1986/1888 (N.I. 18)) and paragraph 5 of Schedule 3 to the Tax Credits Act 2002 (c. 21)

Article 7(2) was amended by paragraph 36(1)(b) of Schedule 9 to the Social Security (Northern Ireland) Order 1986, paragraph 6 of Schedule 3 to the Tax Credits Act 2002 and regulation 4 of S.R. 2008 No. 107

Article 14(5) was amended by paragraph 36(1)(c) of Schedule 9 to the Social Security (Northern Ireland) Order 1986 and paragraph 7 of Schedule 3 to the Tax Credits Act 2002
