The Zoonoses and Animal By-Products (Fees) Regulations (Northern Ireland) 2008

The Department of Agriculture and Rural Development being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community in exercise of the powers conferred on it by the said section 2(2) and in exercise of the powers conferred on it by section 56(1), (2) and (5) of the Finance Act 1973(3) and with the consent of the Department of Finance and Personnel, makes the following Regulations.

Citation and commencement

1.  These Regulations may be cited as the Zoonoses and Animal By-Products (Fees) Regulations (Northern Ireland) 2008 and shall come into operation on 26th September 2008.

Interpretation

2.—(1) In these regulations—

“the 2003 Regulations” means the Animal By-Products Regulations (Northern Ireland) 2003(4);

“the Department” means the Department of Agriculture and Rural Development;

“the European Regulation” means Regulation (EC) No. 2160/2003 of the European Parliament and of the Council on the control of salmonella and other specified food-borne zoonotic agents(5);

“official control samples” means samples taken under point 2.1.2.2 of the Annex to Commission Regulation (EC) No 1003/2005 implementing Regulation (EC) No 2160/2003 as regards a Community target for the reduction of the prevalence of certain salmonella serotypes in breeding flocks of Gallus gallus and amending Regulation (EC) No 2160/2003(6).

“the Scheme” means the Control of Salmonella in Poultry Scheme (Northern Ireland) 2008(7)

(2) The Interpretation Act (Northern Ireland) 1954(8) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Fees

3.  There shall be paid to the Department in respect of the transactions specified in column (2) of the Schedule the fees specified in column (3), such fees being payable within 14 days of demand.

Revocation

4.  The Breeding Flocks, Hatcheries and Animal By-Products (Fees) Order (Northern Ireland) 2004 is hereby revoked (9).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, which apply in Northern Ireland, revoke the Breeding Flocks, Hatcheries and Animal By-Products (Fees) Order (Northern Ireland) 2004.

They make provision for the Department to charge fees for activities required under Commission Regulation (EC) No 1003/2005, Regulation (EC) No 2160/2003 and the Animal By-Products Regulations (Northern Ireland) 2003. The activities are listed in the Schedule.

A regulatory impact assessment, which includes compliance cost assessment of the effect that these Regulations are likely to have on business costs, has been placed in the Library of the Assembly.
