Coming into operation in accordance with regulation 1
1. These Regulations may be cited as The Motor Vehicles (Speed Limits) (Amendment) Regulations (Northern Ireland) 2008 and shall come into operation on the day after they are affirmed by resolution of the Assembly.
2.—(1) The Motor Vehicles (Speed Limits) Regulations (Northern Ireland) 1989(4) are amended as follows.
(2) After regulation 1 (citation and commencement) insert the following regulation—
1A. In these Regulations “the Order of 1997” means the Road Traffic Regulation (Northern Ireland) Order 1997.”
(3) For regulation 2 (speed limits) substitute the following—
“2.—(1) Subject to paragraph (2), the speed at which a motor vehicle is driven on the classes of road specified in the Schedule shall not exceed the maximum speed specified therein for a motor vehicle of the class or description mentioned therein.
(2) Nothing in paragraph (1) shall have effect so as to render lawful any contravention of any of the following provisions in respect of the speed of any motor vehicles, that is to say—
(a)regulations made under Article 20 of the Roads (Northern Ireland) Order 1993(5) (restrictions on use of special roads);
(b)restrictions or prohibitions under Article 7 of the Order of 1997 (temporary traffic regulation);
(c)Article 36 of the Order of 1997 (general speed limit on restricted roads); or
(d)an Order under Article 38 (speed limits on roads other than restricted roads) or Article 40 (temporary or experimental speed limits) of the Order of 1997.”.

These Regulations amend the Motor Vehicles (Speed Limits) Regulations (Northern Ireland) 1989 by inserting a definition for the Road Traffic Regulation (Northern Ireland) Order 1997 and by substituting a new regulation 2.
The Regulations—
(a)in the new regulation 2 (1) prescribe the maximum speed at which a motor vehicle (of a class or description mentioned in the Schedule) may be driven on the class of road specified in that Schedule; and
(b)provide that nothing in the new regulation 2(1) shall render lawful contravention of speed limits under the provisions specified in the new regulation 2(2).
