The Department of the Environment makes the following By-Laws in exercise of the powers conferred by Article 65(1) and (2) of the Road Traffic (Northern Ireland) Order 1981(1).
1. These By-Laws may be cited as the Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2008 and shall come into operation on 1st August 2008.
2. For by-law 26(1) of the By-Laws relating to Motor Hackney Carriages standing or plying for hire made by the Council of the County Borough of Belfast on 4th June 1951(2) there shall be substituted—
“26.—(1) The fares payable for the hire of a Motor Hackney Carriage within the prescribed limits shall be—
(a)where not more than 4 passengers are carried—

(b)additional fare—
(i)for each passenger exceeding 4 carried for the entire distance—

(ii)for each piece of luggage carried on the outside of the Motor Hackney Carriage—
minimum | 20p |

In assessing additional fares, every child under the age of 6 years and/or one child over 6 years and under 12 years shall be disregarded. Two children between the ages of 6 years and 12 years shall be counted as one passenger.”.
3. By-law 2(4) of the Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2006(3) and the Motor Hackney Carriages (Belfast) (Amendment No. 2) By-Laws (Northern Ireland) 2006(4) are revoked.

These By-laws amend the Motor Hackney Carriages (Belfast) By-laws made by the Council of the County Borough of Belfast on 4th June 1951 by revising the rates of fare to be charged.
The percentage rate of increase varies from 13% to 19% depending on the rate band employed.
By-law 2(4) of the Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2006 and the Motor Hackney Carriages (Belfast) (Amendment No. 2) By-Laws (Northern Ireland) 2006 are revoked as a consequence of these By-Laws.
