Coming into operation

The Department of the Environment makes the following By-Laws in exercise of the powers conferred by Article 65(1) and (2) of the Road Traffic (Northern Ireland) Order 1981(1).

Citation and commencement

1.  These By-Laws may be cited as the Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2008 and shall come into operation on 1^st August 2008.

By-Laws amended

2.  For by-law 26(1) of the By-Laws relating to Motor Hackney Carriages standing or plying for hire made by the Council of the County Borough of Belfast on 4^th June 1951(2) there shall be substituted—

“26.— (1) The fares payable for the hire of a Motor Hackney Carriage within the prescribed limits shall be—

(a) where not more than 4 passengers are carried—

1.	Rate 1	Mon-Fri 06.00-20.00	For the first 0.5 miles (805 metres) or part thereof, or for the first 2 minutes and 55 seconds (175 seconds) or part thereof. For every subsequent 135.3 yards (123.7 metres) or part thereof, or 27 seconds or part thereof.	Minimum £3.00 Maximum £3.00 Minimum £0.10 Maximum £0.10
2.	Rate 2	Mon-Fri 20.00-24.00 and Sat-Sun 06.00-24.00	For the first 0.25 mile (402.2 metres) or part thereof, or 1 minutes 35 seconds or part thereof. For every subsequent 125.7 yards (115 metres) or part thereof, or 27 seconds or part thereof.	Minimum £3.00 Maximum £3.00 Minimum £0.10 Maximum £0.10
3.	Rate 3	Any Day 24.00-06.00	For the first 0.125 mile (201.1 metres) or part thereof, or 51 seconds or part thereof. For every subsequent 117.3 yards (107.2 metres) or part thereof, or 27 seconds or part thereof.	Minimum £3.00 Maximum £3.00 Minimum £0.10 Maximum £0.10
4.	Rate 4	14.00 Christmas Eve – 06.00 27 Dec. and 20.00 New Year’s Eve – 24.00 1 Jan.	For the first 0.25 miles (402.2 metres) or part thereof, or 1 minutes 35 seconds (95 seconds) or part thereof. For every subsequent 125.7 yards (115 metres) or part thereof, or 27 seconds or part thereof.	Minimum £4.00 Maximum £4.00 Minimum £0.20 Maximum £0.20

(b) additional fare—

(i) for each passenger exceeding 4 carried for the entire distance—

minimum	40p
maximum	40p

(ii) for each piece of luggage carried on the outside of the Motor Hackney Carriage—

minimum	20p
maximum	20p.

In assessing additional fares, every child under the age of 6 years and/or one child over 6 years and under 12 years shall be disregarded. Two children between the ages of 6 years and 12 years shall be counted as one passenger.”.

Revocation

3.  By-law 2(4) of the Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2006(3) and the Motor Hackney Carriages (Belfast) (Amendment No. 2) By-Laws (Northern Ireland) 2006(4) are revoked.

EXPLANATORY NOTE

(This note is not part of the By-Laws)

These By-laws amend the Motor Hackney Carriages (Belfast) By-laws made by the Council of the County Borough of Belfast on 4^th June 1951 by revising the rates of fare to be charged.

The percentage rate of increase varies from 13% to 19% depending on the rate band employed.

By-law 2(4) of the Motor Hackney Carriages (Belfast) (Amendment) By-Laws (Northern Ireland) 2006 and the Motor Hackney Carriages (Belfast) (Amendment No. 2) By-Laws (Northern Ireland) 2006 are revoked as a consequence of these By-Laws.
