Coming into operation

The Department of the Environment makes the following Order in exercise of the powers conferred by Article 57(2) of the Road Traffic Offenders (Northern Ireland) Order 19961.

In accordance with Article 91(1) of that Order the Department has consulted with such representative organisations as it thinks fit.

Citation and commencement1

This Order may be cited as the Road Traffic (Fixed Penalty) (Offences) (Amendment) Order (Northern Ireland) 2007 and shall come into operation on 30th July 2007.

Amendment of the Road Traffic (Fixed Penalty) (Offences) Order (Northern Ireland) 19972

Schedule 1 to the Road Traffic (Fixed Penalty) (Offences) Order (Northern Ireland) 19972 (fixed penalty offences) is amended as follows—

after item 9 (offences under the Road Traffic (Northern Ireland) Order 1981) insert—

Article 903

Driving, or causing or permitting a person to drive, motor vehicle while uninsured.

after item 12 (offences under the Road Traffic (Northern Ireland) Order 1981) insert—

Article 1774

Failure of driver or owner of vehicle or other person required to do so, to give information for purposes of identification to police.

Breach of requirements as to control of vehicle, mobile telephones etc.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Road Traffic (Fixed Penalty) (Offences) Order (Northern Ireland) 1997 by specifying additional offences committed in respect of a vehicle under Articles 90 and 177 of the Road Traffic (Northern Ireland) Order 1981 and Article 56A of the Road Traffic (Northern Ireland) Order 1995, which are fixed penalty offences for the purposes of Part IV of the Road Traffic Offenders (Northern Ireland) Order 1996. Any liability to conviction of these offences may be discharged by the payment of a fixed penalty which is—

a

£200.00 for using a motor vehicle while uninsured or unsecured against third-party risks;

b

£120.00 for failing to give police information for the purposes of identification of drivers or owners of, and passengers in, vehicles; and

c

£60.00 for breaching construction and use requirements as to the control of a vehicle, using hand-held mobile telephones etc. while driving,

by virtue of the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2007 (S.R. 2007 No. 319).
