HEALTH AND PERSONAL SOCIAL SERVICES

The Department of Health, Social Services and Public Safety(1), in exercise of the powers conferred by Article 19 of the Health and Personal Social Services (Northern Ireland) Order 1972(2) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Health and Personal Social Services (Joint Committee for Commissioning) Order (Northern Ireland) 2007 and shall come into operation on 1st February 2007.

(2) In this Order—

“Board” means a Health and Social Services Board;

“commissioning” means securing the provision of health and personal social services for the people of Northern Ireland;

“the four Boards” means the Northern Health and Social Services Board, the Southern Health and Social Services Board, the Eastern Health and Social Services Board and the Western Health and Social Services Board;(3)

“the 1972 Order” means the Health and Personal Social Services (Northern Ireland) Order 1972.

Establishment of a Joint Committee

2.  There shall be established a Joint Committee for Commissioning (in this order referred to as “the Joint Committee”) for the areas of the four Boards to exercise those functions of the Boards specified in Article 3.

Functions of the Joint Committee

3.  The Joint Committee shall undertake the following functions in relation to the provision of health and personal social services:

(a)the development of a framework and plan for commissioning;

(b)the implementation of efficient and effective commissioning; and

(c)the provision of a management structure and accountability arrangements to manage the resources required to establish and maintain efficient and effective commissioning.

Membership of the Joint Committee

4.  The Joint Committee shall consist of—

(a)a chair appointed by the Department; and

(b)Chief Executive (or person acting in that capacity) of each of the four Boards.

Term of office

5.  The term of office referred to in Article 4(a) shall be a period of 2 years.

Accounts

6.  The Committee shall prepare a statement of accounts in respects expenditure incurred in carrying out its functions in such form and containing such information as is acceptable to the Department.

Modification of Schedule 1 to the 1972 Order

7.  Paragraphs 8 and 10 of Schedule 1 to the 1972 Order shall apply to the Joint Committee subject to the modifications specified in the following paragraphs:—

(1) in each place they appear in those paragraphs, for the words “Health and Social Services Board” and “Board” there shall be substituted the words “Joint Committee”;

(2) in paragraph 8(2), for the words “subject to sub-paragraph (5)” there shall be substituted the words “subject to the approval of the Department”;

(3) paragraph 8 shall be read as if sub–paragraph (5) were omitted: and

(4) in paragraph 10, for “Each” substitute the word “The” and omit the words “and sub committees”.
