ROAD TRAFFIC AND VEHICLES

The Immobilisation and Removal of Vehicles (Prescribed Conditions) Regulations (Northern Ireland) 2006

Coming into operation -

1st January 2007

The Department for Regional Development makes the following Regulations in exercise of the powers conferred on it by Articles 18(1)(b) and 21(1)(b) of the Traffic Management (Northern Ireland) Order 2005(1):

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as The Immobilisation and Removal of Vehicles (Prescribed Conditions) Regulations (Northern Ireland) 2006 and shall come into operation on 1st January 2007.

(2) In these Regulations “the Order” means the Traffic Management (Northern Ireland) Order 2005.

Prescribed conditions

2.  The prescribed condition for the purposes of Articles 18(1)(b) and 21(1)(b) of the Order is that the Department has reason to believe that there are at least 3 separate amounts recoverable by the Department from the owner of the vehicle under Article 15 of the Order.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations prescribe the condition which must be satisfied before the Department may fix an immobilisation device to a vehicle for the purposes of Article 18(1)(b), or remove a stationary vehicle on a public road or in a parking place to another place for the purposes of Article 21(1)(b) of the Traffic Management (Northern Ireland) Order 2005 (“the Order”). The condition is that there are at least three amounts recoverable by the Department from the owner of the vehicle under Article 15 of the Order.
