The Department of Agriculture and Rural Development, being designated(1), for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the Common Agricultural Policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and in exercise of the powers conferred on it by section 56(1), (2) and (5) of the Finance Act 1973(3) and with the consent of the Department of Finance and Personnel, hereby makes the following Regulations.

Citation and commencement

1.  These Regulations may be cited as the Animals and Animal Products (Import and Export) (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 1st September 2006.

Interpretation

2.  The Interpretation Act (Northern Ireland) 1954(4) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendment of the Animals and Animal Products (Import and Export) Regulations (Northern Ireland) 2005

3.—(1) The Animals and Animal Products (Import and Export) Regulations (Northern Ireland) 2005(5) shall be amended in accordance with these Regulations.

(2) In Part I of Schedule 4 after paragraph 2 there shall be inserted—

2A.  Commission Decision 2000/666/EC laying down the animals health requirements and the veterinary certification for the import of birds, other than poultry and the conditions for quarantine (O.J. No. L278, 31.10.2000, p. 26) as read with Council Directive 92/65/EEC..

4.  In Part II of Schedule 4 after paragraph 9 there shall be inserted—

Captive birds

9A.  Commission Decision 2000/666/EC laying down the animal health requirements and the veterinary certification for the import of birds, other than poultry and the conditions for quarantine (O.J. No. L278, 31.10.2000, p. 26) as read with or amended by—

  • Council Directive 92/65/EC;

  • Commission Decision 2001/383/EC (O.J. No. L137, 19.5.01, p. 28);

  • Commission Decision 2002/279/EC (O.J. No. L99, 16.04.02, p.17); and

  • the European International Instruments.

Relevant provisions: Articles 1, 2, 3, 8 and 9..

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Animals and Animal Products (Import and Export) Regulations (Northern Ireland) 2005 S.R. 2005 No. 78.

The Regulations update Schedule 4 in order to bring the implementation of Community instruments as up-to-date as possible. The changes made to Schedule 4 are in relation to the countries from which imports are permitted of captive birds going to approved bodies, institutes or centres and lists instruments covering trade in captive birds going to approved bodies, institutes or centres.
