Planning (Claims for Compensation) Regulations (Northern Ireland) 2006

The Department of the Environment makes the following Regulations in exercise of the powers conferred by Article 129(1) of the Planning (Northern Ireland) Order 1991(1) and Article 67A of the Planning (Northern Ireland) Order 1972(2).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Planning (Claims for Compensation) Regulations (Northern Ireland) 2006 and shall come into operation on 3rd July 2006.

(2) In these Regulations “Department” means the Department of the Environment.

Claims for compensation

2.—(1) A claim for compensation made to the Department under Article 67A (compensation for loss or damage caused by service of building preservation notice) of the Planning (Northern Ireland) Order 1972 shall be made in writing.

(2) Such claim shall be made within 6 months from the date on which the building preservation notice ceases to have effect without the building having been included in a list compiled by the Department under Article 42 (lists of buildings of special architectural or historic interest) of the Planning (Northern Ireland) Order 1991.

Explanatory Note

(This note is not part of the Regulations)

The purpose of these Regulations is to prescribe the time within and the manner in which claims for compensation for loss or damage caused by the service of a building preservation notice shall be made to the Department of the Environment.
