The Police (Northern Ireland) Act 2000 (Continuance of Office of Commissioner) Order 2005

The Secretary of State, in exercise of the powers conferred on him by section 67(6) of the Police (Northern Ireland) Act 2000(1) hereby makes the following Order:

1.  This Order may be cited as the Police (Northern Ireland) Act 2000 (Continuance of Office of Commissioner) Order 2005 and shall come into force on 30th May 2005.

2.  The office of Commissioner, which is provided for by section 67 of the Police (Northern Ireland) Act 2000, shall continue to exist for the period beginning with 31st May 2005 and ending on 31st May 2007.

Explanatory Note

(This note is not part of the Order.)

This Order provides for the office of Police Oversight Commissioner, which is established by section 67 of the Police (Northern Ireland) Act 2000 (“the Act”), to continue to exist until 31st May 2007. Section 67(5) of the Act provides that, unless an order is made prolonging the existence of the office, it will cease to exist on 31st May 2003. The Police (Northern Ireland) Act 2000 (Continuance of Office of Commissioner) Order 2003(2) originally extended that date to 31st May 2005; the current Order extends the Commissioner’s office for a further 2 years. The function of the Commissioner is to oversee the implementation of changes in the policing of Northern Ireland, described in his terms of reference, including, in particular, changes resulting from the Act.
