The Department of Health, Social Services and Public Safety(1), in exercise of the powers conferred on it by Article 13(3) and (4) of the Social Security (Northern Ireland) Order 1988(2), and section 171(2) to (5) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(3) and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Welfare Foods (Amendment No. 2) Regulations (Northern Ireland) 2005.

(2) These Regulations shall come into operation on 28th November 2005.

(3) In these Regulations “the principal Regulations” means the Welfare Foods Regulations (Northern Ireland) 1988(4).

Amendment of the principal Regulations

2.—(1) The principal Regulations are amended as follows:

(a)in regulation 1(2) (Citation, commencement and interpretation) in the definition of “vitamins”, for “A, C and D”, there is substituted “appropriate for the beneficiary who receives them”, and

(b)the definition of “guarantee credit” is deleted.

(2) In regulation 2(1)(b)(iii) (Free milk, dried milk and vitamins), at the end, “or” is deleted.

(3) In regulation 5 (Use of milk, dried milk and vitamins) “and any dried milk obtained by a person pursuant to regulation 4” is deleted.

Revocations

3.  Regulations 2(1)(a)(iii), 2(1)(c), 2(2)(a)(iii), 2(2)(b)(iii), 2(3)(iii) (Free milk, dried milk and vitamins); regulation 4 (Purchase of dried milk at a reduced price); regulation 9 (Inability to purchase dried milk at a reduced price); regulation 10(1)(i), (iii) (Inability to obtain free vitamins) of the principal Regulations are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Welfare Foods Regulations (Northern Ireland) 1988 (“the principal Regulations”).

Regulation 2(1) amends the definition of vitamins in regulation 1(2) of the principal Regulations to ensure there is access to a suitable vitamin product for beneficiaries and deletes the definition of guaranteed credit.

Regulation 3 amends the principal Regulations to remove the entitlement to milk tokens under the Welfare Food Scheme for children not registered at a school as a direct result of their disability and to remove entitlement to low cost infant formula for these families with children under one year old who purchase it through clinics.
