Seeds (Fees) (Amendment) Regulations (Northern Ireland) 2005

The Department of Agriculture and Rural Development, in exercise of the powers conferred on it by sections 1(1), 1(2A)(1), 2(2) and (4) of the Seeds Act (Northern Ireland) 1965(2) and of every other power enabling it in that behalf, after consultation with representatives of such interests as appear to it to be concerned, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Seeds (Fees) (Amendment) Regulations (Northern Ireland) 2005 and shall come into operation on 28th March 2005.

Amendment

2.—(1) Schedule 1 and 2 to the Seeds (Fees) (No. 2) Regulations (Northern Ireland) 2002(3) shall be amended in accordance with the following provisions of this regulation.

(2) In Schedule 1 at paragraphs A(iii), C(ii) and E(ii) after the word “barley” there shall be inserted the word “, triticale”.

(3) After paragraph E (seed lot re-entry fee) to Schedule 1 the following paragraph shall be inserted –

“Additional charges

F.  

(i) F.   Fee for computer self adhesive labels other than for mixtures per thousand (including VAT)	Within one month of demand by the Department	16.37
(ii) Fee for self adhesive roll (no sprocket punch holes) labels other than for mixtures per thousand (including VAT)		16.37
(iii) Fee for card labels other than for mixtures per thousand (including VAT)		19.35
(iv) Fee for official mixture labels, per thousand (including VAT) –
(a) computer self adhesive labels		16.37
(b) self adhesive roll (no sprocket punch holes) labels		16.37
(c) card labels		19.35
(d) double length computer labels		41.64
(v) the above charges also attract –
(a) handling charge (including VAT) per order		10.58
(b) postal charge (including VAT) per parcel		5.11”

(4) After paragraph D (seed lot re-entry fee) to Schedule 2 the following paragraph shall be inserted –

“Additional charges

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Seeds (Fees) (No. 2) Regulations (Northern Ireland) 2002 (S.R. 2002 No. 407), (the “principal Regulations”). The Regulations amend the principal Regulations by inserting an additional entry into Schedules 1 and 2.

These Regulations correct the omission of the fees for official seeds labels and of triticale from the list of seed of the second generation in the principal Regulations.
