The Secretary of State, in exercise of the powers conferred upon him by Articles 1(3), 80 and 81 of the Firearms (Northern Ireland) Order 2004(1) hereby makes the following Order:
1. This Order may be cited as the Firearms (Northern Ireland) Order 2004 (Commencement and Transitional Provisions) Order 2005.
2. “The Order” means the Firearms (Northern Ireland) Order 2004 and “the 1981 Order” means the Firearms (Northern Ireland) Order 1981(2).
3. Parts II, III, IV, V, VI, VII and VIII (with the exception of Articles 79 to 81) and Schedules 1 to 8 of the Order shall come into operation on 1st February 2005.
4. Any firearm certificate granted under Article 28 of the 1981 Order shall continue in force as if granted under Article 5 of the Order but shall expire on the third anniversary of the grant and any condition attached to a certificate granted under Article 28 of the 1981 Order shall remain in force as if attached under Article 6 of the Order.
5. Any entry in the register of firearms dealers under Article 34 of the 1981 Order shall continue in force as if it was a grant of a firearms dealer’s certificate under Article 26 of the Order and any condition attached to the certificate of registration under Article 37 of the 1981 Order shall remain in force as if attached to a firearms dealer’s certificate under Article 27 of the Order.
6. Any authorisation of a firearms club under Article 54 of the 1981 Order shall remain in force as if it was an authorisation under Article 49 of the Order.
7. Until 1st February 2010 a firearm certificate may be granted for a period of three, four or five years at the discretion of the Chief Constable and the fee under Schedule 6 of the Order shall be adjusted until that date to the following –

| Grant of firearm certificate for 4 years | £40 |
| Grant of firearm certificate for 5 years | £50 |

This Order commences the provisions of the Firearms (Northern Ireland) Order 2004 in so far as they did not come into operation in accordance with the Order.
It also provides for transitional arrangements.
