45. Subject to regulation 43(2) and (3) and 44, a person who commits an offence under this regulation shall be liable—
(a)on summary conviction, to a fine not exceeding level 5 on the standard scale;
(b)on conviction on indictment, to a fine or to imprisonment for a term not exceeding two years, or to both.
