The Lord Chancellor in exercise of the powers conferred upon him by section 116(1) of the Judicature (Northern Ireland) Act 1978(1) after consultation with the Lord Chief Justice, and with the concurrence of the Treasury, hereby makes the following Order:
1.—(1) This Order may be cited as the Magistrates' Courts Fees (Amendment No. 2) Order (Northern Ireland) 2004 and shall come into operation on 6th January 2005.
(2) In this Order “the principal Order” means the Magistrates' Courts Fees Order (Northern Ireland) 1996(2).
2. In Section D in Schedule 1 to the principal Order after Fee No. 12(m) there shall be inserted the following new fee:–
“(n)Application to vary or remove conditions with respect to a licence for an indoor arena under Article 77A ... ... ... ... £136·00”.
3. In Section E in Schedule 1 to the principal Order Fee No. 16, Fee No. 17 and Fee No. 18 shall be deleted.

This Order amends the Magistrates' Courts Fees Order (Northern Ireland) 1996 to:
– prescribe the fee to be taken in respect of an application to vary or remove conditions in respect of a licence for an indoor arena under Article 77A of the Licensing (Northern Ireland) Order 1996; and
– delete the fees payable in respect of an application for the grant of a bookmaking office licence, an application for the provisional grant of a bookmaking office licence and an application to have provisional grant of a bookmaking office licence declared final.
