LOCAL GOVERNMENT

The Local Government (Constituting a Joint Committee a Body Corporate) Order (Northern Ireland) 2004

The Department of the Environment, in exercise of the powers, conferred by section 19(9) of the Local Government Act (Northern Ireland) 1972(1), and now vested in it(2), and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Local Government (Constituting a Joint Committee a Body Corporate) Order (Northern Ireland) 2004 and shall come into operation on 15th March 2004.

Interpretation

2.  In this Order –

“joint committee” means the committee formed pursuant to section 19 of the Local Government Act (Northern Ireland) 1972 by the participant councils in pursuance of the terms of the Agreement;

“participant councils” means Antrim Borough Council, Ards Borough Council, Ballymena Borough Council, Belfast City Council, Carrickfergus Borough Council, Castlereagh Borough Council, Down District Council, Larne Borough Council, Lisburn City Council, Newtownabbey Borough Council and North Down Borough Council who make up the Eastern Region Waste Management Group;

“waste management plan” means the sub-regional waste management plan, jointly determined by the participant councils, pursuant to Article 23 of the Waste and Contaminated Land (Northern Ireland) Order 1997(3) which sets out the proposals of the participant councils as to how they would collectively deal with their waste arising over the term covered by the plan;

“the Agreement” means the Agreement entered into by the participant councils to, inter alia, form a joint committee to implement the waste management plan.

Constitution of a joint committee as a body corporate

3.  The joint committee, which is made up of the participant councils, shall be constituted a body corporate with perpetual succession and shall be known as Arc 21 and section 19 of the Interpretation Act (Northern Ireland) 1954(4) shall apply to it.

Functions of Arc 21

4.  Arc 21 shall be established for the purposes of implementing the policies set out in the waste management plan for the disposal and recovery of waste.

Explanatory Note

(This note is not part of the Order.)

This Order provides for the joint committee which is made up of the participant councils to be constituted a body corporate, and to be known as Arc 21.

The Order also fixes the functions of the body corporate.
