5.—(1) Where a former licensee has given a written commitment under regulation 4(4), (6) or (12)(b)(ii), he shall be precluded from being considered under the provisions of paragraphs (2) to (12) of regulation 4 if he applies for a licence.
(2) If the applicant held a licence for the first time in any of the datum years when he was allocated a licence under the provisions of regulation 4(4), (5) or (6) the Commission shall regard the licence held by his parent or spouse for one or both of the previous datum years as having been held by the applicant for the purposes of allocating licences under the provisions of regulation 4(2), (3), (8), (9), (10) and (11).
(3) If the applicant held a licence for the first time in any of the datum years when he was allocated a licence under the provisions of regulation 4(7) the applicant shall be deemed to have held a licence in all previous datum years when the Commission are allocating licences under the provisions of regulation 4(2), (3), (8), (9), (10) and (11).
