The Carers and Direct Payments (2002 Act) (Commencement No. 2) Order (Northern Ireland) 2004

The Department of Health, Social Services and Public Safety(1) in exercise of the powers conferred on it by section 11(1) of the Carers and Direct Payments Act (Northern Ireland) 2002(2), and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Carers and Direct Payments (2002 Act) (Commencement No. 2) Order (Northern Ireland) 2004.

(2) In this Order –

“the Act” means the Carers and Direct Payments Act (Northern Ireland) 2002.

Appointed days

2.—(1) Subject to paragraph (2) 19th April 2004 is the day appointed for the coming into operation of the following provisions of the Act:

(a)Section 8 (Direct payments);

(b)Section 9 (Direct payments in respect of children);

(c)The Schedule

(2) 16th March 2004 is the appointed day for the purposes only of making regulations under sections 8 and 9 of the Act.

Explanatory Note

(This note is not part of the Order.)

This Order provides for the coming into operation on 19th April 2004 of sections 8 and 9 and the Schedule to the Carers and Direct Payments Act (Northern Ireland) 2002. Sections 8 and 9 make provision for the making of direct payments by HSS Trusts in lieu of services whereas the Schedule repeals previous legislation on direct payments.

The Order also designates 16th March 2004 as the appointed day for the purposes of making regulations under sections 8 and 9 of the Act.

The following provisions of the 2002 Act have been brought into operation by the Carers and Direct Payments (2002 Act) (Commencement No. 1) Order (Northern Ireland) 2003 (S.R. 2003 No. 201 (C. 41):
