Public Service Vehicles (Amendment) Regulations (Northern Ireland) 2003

The Department of the Environment, in exercise of the powers conferred on it by Articles 61(1), 66(1) and 218(1) of the Road Traffic (Northern Ireland) Order 1981(1), and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Public Service Vehicles (Amendment) Regulations (Northern Ireland) 2003 and shall come into operation on 30th April 2003.

(2) In these Regulations “the principal Regulations” means the Public Service Vehicles Regulations (Northern Ireland) 1985(2).

Amendments to regulation 6 (inspection of vehicle and grant of licence)

2.—(1) Regulation 6 of the principal Regulations shall be amended in accordance with paragraphs (2) and (3).

(2) After paragraph (2)(f) the word “or” shall be deleted.

(3) After paragraph (2)(g) there shall be inserted–

  • ; or

    (h)

    in the case of a vehicle to which the Public Service Vehicles Accessibility Regulations (Northern Ireland) 2003(3) apply wheelchair restraining devices are not installed in the vehicle at the time it is submitted for examination..

Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the Public Service Vehicles Regulations (Northern Ireland) 1985 (“the 1985 Regulations”).

Regulation 6 of the 1985 Regulations relates to requirements for vehicles submitted for testing. These Regulations amend the said regulation 6 to enable a vehicle examiner to refuse to carry out an examination of a public service vehicle to which the Public Service Vehicles Accessibility Regulations (Northern Ireland) 2003 apply, if wheelchair restraining devices are not installed in the vehicle at the time it is submitted for examination.
