Coming into Force

The Lord Chancellor, in exercise of the powers conferred by Articles 5(3)(a) and 22(1) of the Legal Aid, Advice and Assistance (Northern Ireland) Order 19811 and now vested in him2, hereby makes the following Regulations –

Citation and commencement1

These Regulations may be cited as the Legal Advice and Assistance (Amendment No. 2) Regulations (Northern Ireland) 2002 and shall come into operation on 21st June 2002.

Assistance by way of representation for certain cases under the Life Sentences (Northern Ireland) Order 20012

In regulation 17(3)(b) of the Legal Advice and Assistance Regulations (Northern Ireland) 19813

after the words “those proceedings”, in sub-paragraph (iii), there shall be added the word “, or”;

after the words “Life Sentence Review Commissioners”, in sub-paragraph (iv), there shall be added the word “, or”;

after sub-paragraph (iv), there shall be added the following sub-paragraph –

in respect of a hearing held under Article 10 or 11 of the Life Sentences (Northern Ireland) Order 20014 by a solicitor acting on behalf of the person whose case is or is to be the subject of the hearing

These Regulations extend assistance by way of representation under Article 5 of the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981 to prisoners at hearings held under Articles 10 and 11 of the Life Sentences (Northern Ireland) Order 2001.
