These Regulations define the circumstances in which a street authority, in cases where the undertaker has failed to afford to the authority facilities for inspecting its relevant apparatus (as defined in regulation 1) in a street, may carry out works to enable it to inspect the apparatus where that authority has reasonable cause to believe that the apparatus has not been maintained as required by Article 41(1) and (2) of the Street Works (Northern Ireland) Order 1995. Where the inspection shows that the apparatus has not been so maintained the street authority may carry out emergency works needed in consequence of the undertaker’s breach of statutory duty.
