The Income Support (General) and Jobseeker’s Allowance (Amendment) Regulations (Northern Ireland) 2001

The Department for Social Development, in exercise of the powers conferred by sections 122(1)(a), 131(1) and 171(1) and (3) to (5) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(1) and Articles 6(5) and 36(2) of the Jobseekers (Northern Ireland) Order 1995(2), and now vested in it(3), and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Income Support (General) and Jobseeker’s Allowance (Amendment) Regulations (Northern Ireland) 2001 and shall come into operation on 10th December 2001.

(2) The Interpretation Act (Northern Ireland) 1954(4) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment of the Income Support (General) Regulations and the Jobseeker’s Allowance Regulations

2.—(1) For paragraph 10 of Schedule 3(5) to the Income Support (General) Regulations (Northern Ireland) 1987(6) (housing costs: the calculation for loans), there shall be substituted the following paragraph—

The calculation for loans

10.  The weekly amount of existing housing costs or, as the case may be, new housing costs to be met under this Schedule in respect of a loan which qualifies under paragraph 15 or 16 shall be calculated by applying the formula—

where—

  • A = the amount of the loan which qualifies under paragraph 15 or 16;

  • B = the standard rate for the time being specified in respect of that loan under paragraph 12..

(2) For paragraph 9 of Schedule 2 to the Jobseeker’s Allowance Regulations 1996(7) (housing costs: the calculation for loans) there shall be substituted the following paragraph—

9.  The weekly amount of existing housing costs or, as the case may be, new housing costs to be met under this Schedule in respect of a loan which qualifies under paragraph 14 or 15 shall be calculated by applying the formula—

where—

  • A = the amount of the loan which qualifies under paragraph 14 or 15;

  • B = the standard rate for the time being specified in respect of that loan under paragraph 11..

Explanatory Note

(This note is not part of the Regulations.)

These Regulations amend the Income Support (General) Regulations (Northern Ireland) 1987 and the Jobseeker’s Allowance Regulations (Northern Ireland) 1996 so as to amend the formula for the calculation of the weekly amount of a person’s housing costs to take account of the abolition of mortgage interest payable under deduction of tax.

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992 (c. 8), are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.

These Regulations do not impose any charge on business.
