The Department of the Environment, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the regulation and supervision of working conditions of persons engaged in road transport, in exercise of the powers conferred by that section and of every other power enabling it in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Community Drivers' Hours (Foot-and-Mouth Disease) (Temporary Exception) (No. 2) (Amendment No. 6) Regulations (Northern Ireland) 2001 and shall come into operation on 4th November 2001.
2.—(1) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
(2) In these Regulations “the principal Regulations” mean the Community Drivers' Hours (Foot and Mouth Disease) (Temporary Exception) (No. 2) Regulations (Northern Ireland) 2001(4).
3. In regulation 2(1) of the principal Regulations, in the definition of “prescribed period” for the words “period of 30 days beginning on 4th October 2001” there shall be substituted “period of 56 days beginning on 3rd November 2001”.
4. For paragraph (2) of regulation 3 of the principal Regulations there shall be substituted—
“(2) In relation to the driving of a vehicle in the exceptional circumstances and for the purposes mentioned in paragraph (1), the Council Regulation shall have effect as if in Article 6, paragraph 1 first sentence, for the reference to “nine hours” there were substituted “ten hours” and the second sentence of that paragraph were deleted.
(3) In relation to the driving of a vehicle in the exceptional circumstances mentioned in paragraph (1) and for the purpose only of the movement of livestock, the said Council Regulation shall have effect as if in Article 8, for paragraph 3 there were substituted the following—
“3. In the course of each week, one of the rest periods referred to in paragraphs 1 and 2 shall be extended, by way of weekly rest, to a total of 24 consecutive hours. Every third week this rest period shall be extended to a total of 45 consecutive hours.””.

These Regulations extend the expiry date of the exceptions for a further period of 56 days from (and including) 4th November to (and including) 29th December 2001. The European Commission has authorised the continuation of the temporary exception provided for by these Regulations.
The Regulations also provide for the removal of the temporary exception to the weekly rest requirement, except for vehicles being driven for the purpose of the movement of livestock.
