LEGAL AID AND ADVICE

The Legal Advice and Assistance (Amendment No. 3) Regulations (Northern Ireland) 2001

The Lord Chancellor, in exercise of the powers conferred by Articles 5(3)(a) and 22(1) of the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981(1) and now vested in him(2), hereby makes the following regulations:—

Citation and commencement

1.  These Regulations may be cited as the Legal Advice and Assistance (Amendment No. 3) Regulations (Northern Ireland) 2001 and shall come into operation on 1st September 2001.

Interpretation

2.  In these regulations “the principal regulations” means the Legal Advice and Assistance Regulations (Northern Ireland) 1981(3).

Amendment of the principal Regulations

3.  In regulation 3 of the principal regulations after the meaning of “Legal Aid Committee” there shall be added the following meaning—

“Life Sentence Review Commissioners” means the Life Sentence Review Commissioners appointed by the Secretary of State under Article 3 of the Life Sentences (Northern Ireland) Order 2001(4);.

4.  In regulation 17(3)(b) of the principal regulations—

(a)the words “it is made” in sub-paragraph (iii) shall be omitted;

(c)after sub-paragraph (iii), there shall be added the following sub-paragraph—

(iv)in respect of a hearing before the Life Sentence Review Commissioners..

These Regulations extend assistance by way of representation, under Article 5 of the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981, to life sentence prisoners at hearings before the Life Sentence Review Commissioners.
