The Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2001

The Department of the Environment, in exercise of the powers conferred on it by Article 17(7) of the Clean Air (Northern Ireland) Order 1981(1) and of every other power enabling it in that behalf, being satisfied that the classes of fireplace prescribed in column (1) of the Schedule can be used for burning fuel other than authorised fuels without producing a substantial quantity of smoke, hereby makes the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2001 and shall come into operation on 2nd July 2001.

Amendment

2.  The classes of fireplace described in paragraphs 4(a) and 20(a) as listed in the Schedule to these Regulations shall be added to Schedule 1 to the Smoke Control Areas (Exempted Fireplaces) Regulations (Northern Ireland) 1999(2) after paragraphs 4 and 20 respectively.

Classes of fireplaceConditions

4.—(a) The Beech Wood Fired Pizza Oven manufactured by Beech Wood Fired Ovens, Brisbane, Australia.

1.  The fireplaces shall be installed, maintained and operated in accordance with the manufacturer’s instructions dated 3rd March 2000 and bearing the reference “BBP236UK”.

2.  No fuel shall be used other than untreated dry hardwood.

20.—(a) The Morsø 3400 Owl GB Series for wood burning manufactured by Morsø Jernstøberi A/S, Denmark

1.  The fireplaces shall be installed, maintained and operated in accordance with the manufacturer’s instructions dated 1st January 2000 and bearing the reference “72345600”.

2.  No fuel shall be used other than—

(a)untreated dry wood, which has been split, stacked and air dried; or

(b)air dried wood briquettes.

Explanatory Note

(This note is not part of the Regulations.)

Article 17 of the Clean Air (Northern Ireland) Order 1981 (“the 1981 Order”) generally prohibits the emission of smoke in smoke control areas. Under paragraph (7) of Article 17 of the 1981 Order, the Department may exempt certain classes of fireplace from the provisions of Article 17 if it is satisfied they can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke.

The Smoke Control Areas (Exempted Fireplaces) Regulations (Northern Ireland) 1999 (“the 1999 Regulations”) which came into operation on 2nd August 1999 prescribed those fireplaces exempted from the provisions of Article 17 of the 1981 Order.

These Regulations amend Schedule 1 of the 1999 Regulations by exempting two additional classes of fireplace. These are the Beech Wood Fired Pizza Oven and the Morsø 3400 Owl GB Series for wood burning.
