The Department of the Environment in exercise of the powers conferred by Articles 9 and 14 of, and Schedule 3 to, the Superannuation (Northern Ireland) Order 1972(1) and now vested in it(2) and of every other power enabling it in that behalf and after consultation with such associations of local authorities as appeared to it to be concerned, the local authorities with whom consultation appeared to it to be desirable and such representatives of other persons likely to be affected by the Regulations as appeared to it to be appropriate, hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Local Government (Superannuation) (Amendment) Regulations (Northern Ireland) 2000 and shall come into operation on 13th April 2000 and, except as provided in paragraph (2) shall have effect from that date.
(2) Regulation 2 shall have effect from 6th April 1988.
(3) In these Regulations “the principal Regulations” means the Local Government (Superannuation) Regulations (Northern Ireland) 1992(3).
(4) So far as is necessary for the purpose of these regulations, the principal Regulations shall be deemed to have effect from and including 6th April 1988.
2. Regulation J2 of the principal Regulations shall be amended by the deletion of paragraph (5).

These regulations amend the Local Government (Superannuation) Regulations (Northern Ireland) 1992 (“the principal Regulations”).
Regulation 2, which has effect from 6th April 1988, removes a provision in the principal Regulations dealing with the interchange of funds which prevented, with two exceptions, the payment of transfer values between public sector schemes which participate in public sector transfer arrangements for persons who ceased employment before 31st March 1972.
Article 14 of the Superannuation (Northern Ireland) Order 1972 confers express powers to make regulations retrospective in effect. These regulations are retrospective, however, no one will be adversely affected by the retrospective amendment.
